Acceptance of Terms

By participating in this Program, you agree to abide by these terms and conditions, collectively referred to as the "Terms." If you do not agree with these Terms, we kindly ask you to refrain from participating in the Program.

Eligibility

To be eligible for the Program, you must:

• Have a valid email address.
• Possess a valid mobile number.
• Be willing to provide additional Know Your Customer (KYC) details if required for redemption, depending on your country of residence

Please review these "Terms and Conditions" carefully. This Agreement has implications for your rights, while other services provided by Goldbck may have separate terms.

This Agreement constitutes a legally binding contract between individuals who enroll in any of the Programs (referred to as "Members") or utilize any of the Company Properties. If you are a Member or use any Company Property, you acknowledge that you have read, comprehended, and consented to comply with all the terms and conditions outlined in this Agreement. If you are unable or unwilling to accept the terms of this Agreement, we respectfully request that you discontinue participation in the Program(s) and promptly terminate your Program membership(s).

Additionally, you consent to mandatory individual arbitration and waive the right to participate in class-action lawsuits or jury trials for dispute resolution with the Company, except for matters within the jurisdiction of small-claims court. The Goldbck Reward services are operated by GLOBAL HOTELIER PTE. LTD, TRAVOLIERPAY INDIA PVT LTD, & TRAVOLIERPAY LTD UK, alongside their affiliates, collectively referred to as "Goldbck" and "eGOLD Rewards." This service allows users to accumulate loyalty points backed by "Digital GOLD" when booking and purchasing goods and services, as well as accessing other services on the website located at www.goldbck.com, its network of websites, software applications, and any other products or services offered by Goldbck (collectively referred to as "Goldbck Services," including "eGOLD PAY," "eGOLD SHOP," "eGOLD TRAVEL," "eGOLD POINTS," and "eGOLDSHOPPING").

eGOLD Rewards Points are represented as "eGold." One eGold (eGOLD point) equals 100 micrograms (mcg) of Gold. The price of Gold points is determined at the time of issuance, and these eGold points are granted based on a portion of the commission received from affiliated partners.

Financial Regulation

It's essential to understand that TRAVOLIERPAY INDIA PVT LTD, TRAVOLIERPAY LTD UK, and GLOBAL HOTELIER PTE LTD are not regulated financial services providers. All user balances and transactions are safeguarded by third-party licensed payment institutions.

Site Management

The website www.goldbck.com (referred to as the "Site") and the eGOLD Rewards Program (referred to as the "Goldbck Rewards Program") are managed by Global Hotelier Pte. Ltd., TravolierPay India Pvt Ltd, & TravolierPay Ltd UK (hereinafter "we," "us," or "our"). These entities reserve the right to terminate and modify the Rewards Program and Terms and Conditions at their discretion, without prior notice.

By accessing the site, participating in the Rewards Program, or utilizing the Goldbck Services, you declare that you have read, comprehended, and agreed to the Terms of Use as set out below. Additional terms and conditions related to the site can be found in the general Site Terms of Use, privacy policy, and FAQs, all of which form an integral part of these Rewards Program Terms of Use ("Rewards Program Terms").

The Goldbck Services are not accessible to individuals under 18 years of age or users who have previously been barred from the Goldbck Services. Furthermore, the Goldbck Services are unavailable to individuals prohibited from using them under the laws of Singapore, the European Union, UK, Delhi international arbitration centre, New Delhi, India, or any other relevant jurisdiction.

By downloading, installing, or otherwise using the Goldbck services (eGOLD Rewards), you confirm that you are at least 18 years old and possess the legal capacity required by your jurisdiction of residence. You also affirm that you have not been previously excluded from or prohibited from using the Goldbck services.

Please note that we reserve the right to modify, amend, append, or delete these Rewards Program Terms at any time without prior notice. This includes any rules, regulations, benefits, or conditions related to participation, which may or may not affect the value of the Goldbck Rewards. Each modification takes immediate effect, and it is your responsibility to periodically review these Rewards Program Terms.

The most recent version of these Terms and Conditions will be accessible on our website and will supersede all prior versions. Continuing to use the Company Property following any notifications indicates your acceptance of these modifications and your commitment to adhere to these Terms and Conditions. If you disagree with any changes to these Terms and Conditions, your only recourse is to discontinue using the Company Properties.

By persistently using this site and participating in the Rewards Program after changes to these Rewards Program Terms, you confirm your agreement and acceptance of these changes. For other services, your usage is subject to the submission and acceptance of the applicable terms and conditions.

Subject to the provisions of this Agreement, we grant you a non-exclusive, non-transferable license (without the right to sublicense) to access and use the Company Properties for personal use in accessing the Program(s). You acknowledge that you gain no rights beyond those explicitly granted in this Agreement. The Company retains the right to modify, upgrade, or discontinue the Program, any Company Property, or any feature of the Program or the Company Properties, with or without prior notice. The Company and its licensors retain all rights not expressly granted under this Agreement.

You affirm that you, as well as those acting on your behalf, shall not:

• Harm, disrupt, or unduly burden the Company Properties.
• Introduce any code designed to disrupt the Program into the Company Properties.
• Modify or erase any Content available via the Company Properties.
• Access the Program or the Company Properties through automated means, such as expert systems, electronic agents, or "bots."
• Utilize scripts or concealed redirects to derive financial gains from the Company.
• Alter, reverse engineer, decompile, copy, or derive the source code of any Company Property for any purpose.
• Lease, sell, or sublicense any Company Property.
• Provide unauthorized third parties access to the Program.
• Access or attempt to access confidential content through the Company Properties.
• Disrupt the operation of the Program, including distributing unsolicited advertising, computer worms, viruses, or other harmful elements.
• Publish any defamatory, obscene, or unlawful material on the Company Properties or within the Program.
• Infringe upon the intellectual property rights of any third party or misappropriate trade secrets.
• Engage in any illegal, manipulative, or misleading activity through the Program.
• Employ manual or automated software, devices, or processes to scrape, crawl, spider, or index any page of Content from the Company Properties.

Please read these Terms and Conditions ("Terms and Conditions" or "Agreement") carefully. This Agreement affects your rights - other services provided by Goldbck may be subject to separate terms. This Agreement constitutes a legally binding agreement between each individual who enrolls in any of the Programs ("Member") or otherwise uses any one of the Company Properties. If you are a Member or use any of the Company Properties, You agree that you have read this Agreement, understand it, and agree to be bound by all its terms and conditions. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DISCONTINUE PARTICIPATION IN AND USE OF THE PROGRAM(S) AND TERMINATE YOUR PROGRAM MEMBERSHIP(S) IMMEDIATELY. You agree to the mandatory individual arbitration and class action/jury trial waiver provisions to resolve any disputes with the Company, except for those matters that may be taken to small-claims court.

The Goldbck Reward services are operated by GLOBAL HOTELIER PTE. LTD, TRAVOLIERPAY INDIA PVT LTD, & TRAVOLIERPAY LTD UK (with its affiliates, "Goldbck" and "eGOLD Rewards"). This enables users to gain loyalty points backed by "Digital GOLD" for booking and purchasing goods and services and using other available services on the website available at www.goldbck.com, and its network of websites, software applications, or any other products or services offered by Goldbck (the "Goldbck Services," "eGOLD PAY," "eGOLD SHOP," "eGOLD TRAVEL," "eGOLD POINTS," "eGOLDSHOPPING").

eGOLD Rewards Points are termed “eGold”. One unit of eGold (eGOLD point) is 100 micrograms (mcg) of Gold. The price of Gold points is determined at the time of issuing points, and the eGold points are given based on a portion of the commission received from the affiliate partner.

The Cashback value to the Member is converted into eGOLD Points. The value of Gold points may vary as per the trading price of Gold.

Please note that we may change, modify, add, and delete these Rewards Program Terms at any time without prior notice, in whole or in part, including any rules, regulations, benefits, or conditions of participation, which may or may not affect the value of the Goldbck Rewards (as defined below). Each such modification will take immediate effect. These Rewards Program Terms must be read periodically.

The most current version of these Terms and Conditions will be available on our website and will supersede previous versions. Your continued use of the Company Property following any such notifications constitutes your acceptance of such modifications and your Agreement to be bound by these Terms and Conditions. If you do not agree to any modification of these Terms and Conditions, your sole remedy is to discontinue your use of the Company Properties.

By continuing to use this site and participating in the Rewards Program after changes to these Rewards Program Terms, visitors, users, or Registered Users ("You" or "User") acknowledge that you agree and consent to the changes. If you use any of our other services, your usage is based on submitting and accepting the terms and conditions applicable to such services. Subject to this Agreement, we hereby grant you a non-exclusive, non-transferable license (without the right to sublicense) to access and use the Company Properties for your personal use to access the Program(s). You agree that you obtain no rights other than the rights and licenses expressly granted in this Agreement. The Company reserves the right to change, upgrade, or discontinue the Program, any Company Property, and any feature of the Program or the Company Properties, at any time, with or without notice. Company or its licensors reserve all rights not expressly granted under this Agreement.

You agree that you will not, and will not permit others to:

1. damage, interfere with or unreasonably overload the Company Properties;
2. introduce into the Company Properties any code intended to disrupt the Program
3. alter or delete any information, data, text, links, images, software, chat, communications and other content available through the Company Properties (collectively, "Content")
4. access the Program or the Company Properties by expert system, electronic agent, "bot" or other automated means
5. use scripts or disguised redirects to derive financial benefit from Company
6. modify, reverse engineer, reverse assemble, decompile, copy or otherwise derive the source code of any Company Property for any reason
7. rent, sell or sublicense any of the Company Properties
8. provide any unauthorized third party with access to the Program
9. access or attempt to access confidential content through the Company Properties
10. interfere with the operation of the Program, including, but not limited to, distribution of unsolicited advertising or mail messages and propagation of computer worms and viruses
11. post any material in any form whatsoever on the Company Properties or within the Program that is defamatory, obscene or otherwise unlawful or violates any third party's right of privacy or publicity;
12. infringe any third party's patent, copyright, service mark, trademark or other intellectual property right of any kind or misappropriate the trade secrets of any third party in connection with your use of the Program or the Company Properties
13. engage in any activity that does not comply with applicable law and regulations or otherwise engage in any illegal, manipulative or misleading activity through the use of the Program
14. use the manual or automated software, devices or other processes to "scrape," "crawl," "spider" or index any page of Content from the Company Properties.

Cashback (Goldback) is eGOLD Points. We offer the ability for Members to earn Cashback (Goldback) in eGOLD Points (eGold) referred to as ("Cashback (Goldback)") on their purchases completed through the Company Properties. The Company receives compensation for referring buyers to the retailers, brands, merchants, and other partners participating in this Program ("Affiliate Stores"). The Company gives a portion of this fee to its Members as Cashback (Goldback) in the Cashback (Goldback) value in Gold Points.

The compensation received by the Company may play a part in whether retailers and products appear on our site, where they are placed, and how we promote them to you. Participation in this Program and the opportunity to earn Cashback (Goldback) are offered at the Company's sole discretion and subject to your compliance with this Agreement.

Earning Points

You can accumulate Points by making purchases either on the Goldbck website or through its affiliate partners. The rate at which Points are earned per dollar spent varies depending on the vendor. For example, when you shop on the Goldbck website (eGOLD Rewards), you might earn 1 Point for every dollar spent.
Cashback (Goldback) is essentially equivalent to eGOLD Points. We offer our Members the opportunity to earn Cashback (Goldback) in the form of eGOLD Points (eGold) when they make purchases through the Company Properties. The Company receives compensation for referring buyers to retailers, brands, merchants, and other partners participating in this Program (referred to as "Affiliate Stores"). A portion of this compensation is returned to our Members as Cashback (Goldback) in the form of eGOLD Points.
The compensation received by the Company may influence the visibility and placement of retailers and products on our site, as well as how we promote them to you. Participation in this Program and the ability to earn Cashback (Goldback) is solely at the discretion of the Company and is subject to your compliance with this Agreement.

Online Cashback (Goldback) in eGOLD points can be earned by:

• Registering for an Account.
• Signing in to one of the Company Properties.
• Using shopping links within the Company Properties.
• Completing your purchase transaction during the same shopping session that started with clicking on the shopping link.

If you visit other sites before completing your purchase or use coupons not provided by the Company, your purchase may not be associated with our service, and you may not earn Cashback (Goldback). Disabling "cookies" on your computer will also prevent you from earning Cashback (Goldback) because cookies are used for user authentication and verifying which Member

Account is eligible for Cashback (Goldback).

In-Store Cashback (Goldback) may also be offered, allowing you to earn eGOLD Points for purchases made at specific physical Affiliate Store locations. To be eligible for In-Store Cashback (Goldback), you must link your payment card to an "in-store" offer ("Card Linked Offer") and subsequently use that payment card to complete the purchase following the terms of the Card Linked Offer. The specific terms of In-Store Cashback (Goldback) and each Card Linked Offer will determine how In-Store Cashback (Goldback) is earned and paid, to the extent that they differ from this Agreement.

We may provide a Browser Extension to enhance your Cashback (Goldback) shopping experience. The use of the Browser Extension is governed by the Goldbck Cashback (Goldback) privacy policy and will prevail in case of any variations from this Agreement.
Periodically, the Company may offer gift cards as part of a promotion or as a redemption option for your Cashback (Goldback). These gift cards are subject to the terms and conditions of the gift card issuer, as well as the relevant policies of the Affiliate Store. Gift cards issued as sign-up bonuses are provided in physical form.

Cashback (Goldback) Exclusions: Cashback (Goldback) is earned based on your net purchase amount, which excludes taxes, fees, shipping costs, gift-wrapping, discounts, credits, returns, cancellations, and extended warranties. Purchases of gift cards generally do not qualify for Cashback (Goldback). The Cashback (Goldback) amount can vary depending on the store and product category, and there may be exclusions specific to each offer and store. Please carefully review these terms.

Store Policies: Products you purchase from Affiliate Stores or Sellers, whether online or in-store, are subject to the respective policies of the Affiliate Store or Seller. This includes exchange and shipping policies. It's important to note that we are not agents of any Affiliate Store or Seller, and these entities operate independently beyond our control. Therefore, your interactions with Affiliate Stores or Sellers, including participation in offers or promotions, are solely between you and the respective Affiliate Store or Seller. We assume no liability, obligation, or responsibility for any aspect of such interactions, including offers, promotions, or changes to or withdrawal from the Program by Affiliate Stores or Sellers. We are also not responsible for any impact on Cashback (Goldback) accrual due to such changes, discontinuation, or withdrawal.

Bonuses and Other Rewards: The Company periodically offers bonuses or rewards for referring new Members to the Program or for specific actions. The terms and conditions associated with these offers will dictate how they are earned and paid if they differ from this Agreement. All bonuses and rewards are subject to review by the Company, and we reserve the right to withhold, deny, or cancel any bonuses and/or rewards and/or terminate your Account if, at our sole discretion, we deem any bonuses and/or rewards as fraudulent, abusive, unethical, suspicious, or otherwise inconsistent with our Referral Program Terms, this Agreement, or any applicable law or regulation. Redemption & Issuance of eGold and Other Rewards

Requirements: To receive eGOLD points (eGold) and other rewards, you must meet certain requirements as outlined below:

1. Verification of Identity: You may be required to provide supplementary Know Your Customer (KYC) details, especially if needed for redemption and depending on your country of residence. This is to ensure compliance with legal and regulatory requirements.
2. Accrual of eGOLD Points: You can earn eGOLD Points by making purchases on the Goldbck website or through affiliate partners. The rate of earning points may vary depending on the specific vendor and purchase amount.
3. Cashback (Goldback): Cashback (Goldback) is equivalent to eGOLD Points and can be earned through your purchases. The Company receives compensation for referring buyers to participating retailers, and a portion of this fee is given back to Members as Cashback (Goldback) in the form of eGOLD Points.
4. Online Cashback (Goldback): To earn Cashback (Goldback) in eGOLD points online, you must register for an Account, sign in to one of the Company Properties, use shopping links within the Company Properties, and complete your purchase during the same shopping session that began with clicking on the shopping link. Visiting other sites before completing your purchase or using unauthorized coupons may affect your Cashback (Goldback) eligibility.
5. In-Store Cashback (Goldback): In-Store Cashback (Goldback) allows you to earn eGOLD Points for purchases made at specific physical Affiliate Store locations. To be eligible, you must link your payment card to an "in-store" offer ("Card Linked Offer") and use that payment card to complete the purchase according to the Card Linked Offer's terms.
6. Browser Extension: The Browser Extension may enhance your Cashback (Goldback) shopping experience. Usage of the Browser Extension is subject to the Goldbck Cashback (Goldback) privacy policy.
7. Gift Cards: The Company may offer gift cards as part of promotions or as redemption options for your Cashback (Goldback). These gift cards are subject to the terms and conditions of the gift card issuer and the relevant policies of the Affiliate Store.

Cashback (Goldback) Exclusions: Cashback (Goldback) is typically earned based on your net purchase amount, excluding taxes, fees, shipping, gift-wrapping, discounts, credits, returns, cancellations, extended warranties, and purchases of gift cards. Exclusions may vary by store and product category.

Store Policies: Products purchased from Affiliate Stores or Sellers, whether online or in-store, are governed by the policies of the respective Affiliate Store or Seller, including exchange and shipping policies. The Company is not responsible for these policies or any interaction you have with Affiliate Stores or Sellers.

Bonuses and Other Rewards: The Company may offer bonuses or rewards for referring new Members or for specific actions. The terms and conditions of these offers will dictate how they are earned and paid, and the Company reserves the right to review and enforce these terms.

Donations: Goldbck.com provides you with the option to donate a portion or all of your Cashback (Goldback) earnings to charitable causes. Importantly, Goldbck does not charge any fees for this service nor does it deduct any percentage from the donated Cashback (Goldback) earnings. It's crucial to note that donations made through Goldbck are not eligible for tax deductions. Further details regarding donations can be found in a separate section outlining additional terms and conditions.

Account Adjustments: Goldbck.com reserves the right to make adjustments to your Account by deducting Cashback (Goldback) in cases involving returns or cancellations related to Cashback (Goldback) Program purchases. These adjustments are carried out at the sole discretion of Goldbck and are in full compliance with this Agreement, applicable Company policies and terms, the conditions set forth by Affiliate Store offers, as well as all relevant laws, rules, and regulations. It's important to understand that the determination of whether a purchase made through an Affiliate Store qualifies for Cashback (Goldback) rests entirely with Goldbck.

In instances where an Affiliate Store fails to report a transaction to Goldbck or neglects to make payments to Goldbck for any reason, Goldbck reserves the right to cancel the associated Cashback (Goldback) linked to that specific transaction. Monitoring your Account regularly to ensure the accurate crediting and payment of Cashback (Goldback) and the accuracy of your Account balance is your responsibility. If you believe that your eGOLD points have not been correctly credited to your Account, you must contact Company Member Services within ninety (90) days of the transaction. Additionally, the Company retains the discretion to make adjustments to Accounts concerning any Cashback (Goldback) it deems fraudulent, abusive, unethical, suspicious, or in violation of the Referral Program Terms outlined in this Agreement or any other applicable laws or regulations. Please note that Company decisions in these matters are considered final. If you disagree with any adjustments made to your Account or the payments issued to you, your sole recourse is to withdraw from the Program.

Taxes: It's important to be aware that you may be subject to taxation on bonuses and other benefits, such as merchandise or travel, received through member referrals or other promotional activities. The applicability of these taxes depends on the tax laws of federal, state, and local jurisdictions. You are solely responsible for

Account Updates: By agreeing to these terms, you commit to maintaining the accuracy, completeness, and currency of your Account information by regularly updating it within the Company Properties. To effect changes to your Account details and payment preferences, you must log in to your Company account and provide your password. You have the capability to monitor your account status and review recent transaction and earnings history at any time within the Company Properties. Safeguarding your account information, including your username and password used for Program access, is your responsibility. Any use of your username and password will be treated as your own action, and the Company is authorized to act based on instructions received through your password, without assuming liability for transactions carried out by another party using your password. In the event of a security breach involving your Account, it is essential that you promptly change your password and notify us of such a breach. Failing to report such a breach in a timely manner will lead to the presumption that any instruction transmitted using your username and password is genuine and authorized by you, relieving us of any obligation to investigate the propriety of such instruction.

Account Activity: To maintain an Active Account, you must have engaged in one of the following activities within the past twelve (12) months:

1. Updated your Account information.
2. Shopped or initiated a shopping trip via the Company Properties.
3. Linked a payment card to an in-store offer.
4. Accrued Cashback (Goldback).
5. Logged in to your Account.

Should your Account remain inactive for more than twelve (12) consecutive months, and if the balance in your inactive Account is zero or becomes zero, the Company reserves the right to permanently close the Account and cease the maintenance of your account records and Program access. In certain force majeure situations, extensions of 6-12 months may be granted, subject to a case-by-case evaluation.
Please note that, unless prohibited by applicable law, if you have not engaged in any of the activities mentioned above for more than twelve (12) consecutive months, the Company may debit your Account balance with a monthly "Maintenance Fee" of two dollars ($2.00). This fee is intended to cover the cost of account maintenance conducted as part of our regular business operations until you reactivate your Account by participating in one of the activities listed in the subsections above, or until your account balance reaches zero. Importantly, these Maintenance Fees are non-refundable and will not result in a negative account balance or create any debt to the Company. Any owed amount may be deducted from the Points held in your Member's Account, with any remaining Points being forfeited for Accounts that have been inactive for twelve (12) consecutive months.

Fraudulent Activity: We have the right to thoroughly investigate any actions, including purchases, referrals, or interactions with our platform, that we suspect, at our sole discretion, are abusing or have abused the Program. If we determine that a member is abusing or has abused the Program, we reserve the right to revoke Cashback (Goldback), disqualify them from future rewards, and terminate their account. Examples of abuse include consistently returning products after receiving Cashback (Goldback) credits or creating multiple accounts for fraudulent referrals. Accounts created under the Refer-A-Friend Program with identical names, addresses, email addresses, or other identifying features may be considered fraudulent referrals. If we suspect or detect fraudulent activity linked to your account, we may choose to delay or withhold Cashback (Goldback) payments. Any suspected or confirmed instances of fraudulent activity will be escalated and reviewed following our established fraud process. Decisions made by us are final.

By providing Feedback, you grant us, our affiliates, and agents a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display the feedback for any legal purpose, including using it in advertising and promotional materials or improving our products, services, and those of our affiliates.

Community Behavior: Your participation in the Program means you are part of a community that relies on responsible conduct. Members must refrain from transmitting or communicating content that may constitute ethnic slurs, obscenities, sexually explicit material, inflammatory or derogatory comments, or anything construed as harassing or offensive. This prohibition extends to content targeted at the Program, the Company Properties, our employees, contractors or agents, our Affiliate Stores or Sellers, or other Members. Communication through social media or other internet posts that breach these community standards or promote fraudulent behavior is also not allowed. Breaching this provision may result in the suspension or termination of your access to the Program at our discretion, without prior notice.

Intellectual Property: All rights, titles, and interests in the Program, the Company Properties, and the Content belong to the Company or its licensors. The Company retains all rights, title, and interest in its trademarks, including "Goldbck," "eGold," the Goldbck logo, the eGold logo, and other marks, service marks, trademarks, or logos. These marks must not be used in connection with unrelated products or services or in a way that may cause customer confusion or disparage the Company. Bidding on keywords containing these marks in search engines, using them in ad text, extensions, or banner ads without written consent from the Company is also prohibited. All other trademarks used in the Programs that are not owned by the Company are the property of their respective owners and may or may not be affiliated with the Company.

Indemnification: You agree to indemnify the Company, our Affiliate Stores, our Sellers, their respective officers, directors, employees, successors, agents, and affiliates against all claims, damages, losses, and causes of action, including attorneys' fees and court costs, arising from your breach of this Agreement or the materials you provide, including those provided through your username and/or password. You acknowledge that we hold no liability to you or any third party for any changes, suspensions, or terminations of the Program or your access to Company Properties. If you find any aspect of the Program unsatisfactory, your only recourse is to discontinue your participation.
